摘要
学习权是儿童的一项基本权利,不仅要求公正地分配学习资源,还要求获得自由的学习过程。可见,公正与自由是考察学习权的两个重要维度,所有儿童公正地享有学习资源与享受自由的学习过程。从公正的立场看,儿童学习权的具体保障强调自由平等、能力匹配与教育补偿的"词典式"结合。从自由的立场上看,儿童学习权的实现依赖于去除干涉的消极自由与自我实现的积极自由相结合。
Learning fights is a children' s basic fights, not only requires equitable distribution of learning resources, also requires being free of the learning process. Clearly, justice and freedom are the two important dimensions of studying Learning fights. Taking the view of justice, freedom and equality are the safeguarding learning fights. It also asks for matching the children's ability. The third step is to flint step of compensate the people who are in disadvantaged situation. Taking the view of liberty, children's learning depends on the connection between negative liberty and positive liberty.
