摘要
生态补偿是运用经济手段实现生态保护与恢复的一项重要环境制度,将其以法律的形式固化对西部民族地区生态保护具有重要现实意义。从生态补偿法律机制理论分析为切入口,论证了生态补偿与西部民族地区生态保护现实需求的洽合性对接。以批判的思维对我国生态补偿相关法律制度在根基缺省、体系结构性缺陷及民族性方面进行了镜像反观,立足本土实况对西部民族地区生态补偿法治化路向做出了制度性谋划。
The ecological compensation is an lmpurtant system to realize ecosystem＇s protection and instauration by economic means, legalizing of the ecological compensation will creat reality meanings for the ecosystem＇s protection of western ethnic minority regions, with the ecological compensation mechanism as the key to the successful process. On the basis of thoroughly analysis our national ecological compensation by the criticizational thinking,to design system planning on legalizing of the ecological compensation in the western ethnic minority regions at the end.
