摘要
法律所提供的制度框架改变、强化市场主体的利益结构,并以此改变、指引人们的行为。《劳动合同法》改变了用人单位的成本收益结构,有利于该法的实施。但劳动合同的性质决定其强烈依赖于国家提供的第三方保护,因此完善劳动争议解决机制以降低劳动者寻求救济的交易成本是贯彻落实《劳动合同法》的关键。
Institutional structure provided by law always changes and strengthens the interests structure of market entity, furthermore it can change and guide people's behaviors. Labor Contract law will alter the cost-benefit structure of employers, so it is necessary to apply the law in market. But the nature of labor contract depends on protection of country urgently. Thus, it is crucial to apply the Labor Contract Law to perfect the mechanism of settlement of labor disputes by lowering the transaction cost borne by employees in seeking remedies.
