城乡规划在执行过程中遇到各种各样的"阻滞",其原因既有体制上的缺陷,亦有规划督察体系建设的滞后,如不重视规划的执行与绩效评估,规划强制执行权不明晰,依法批准的法定规划不能被严格执行,对"规划行政不作为"缺乏惩戒等等。2005-2007年城乡规划效能监察在全国范围内开展,但收效并不理想;程序公正与集体土地问题仍然是很长一段时间内规划督察体系建设的重点。
In China, the urban-rural planning en- counters a variety of ＂blocks＂ in the process of implementation, which are mainly caused by some defects of the existing system and also by the delayed construction of a system of planning inspectorate. Specifically, the planning implementation and per- formance evaluation is not emphasized, the planning enforcement is not clear, the statutory plan can not be strictly enforced, punitive measures are lacked for ＂dereliction of duty in planning administration＂, and so on. From 2005 to 2007, a nationwide inspectorate of the effectiveness of urban-rural planning was launched, but the result was not satisfactory. For a very long time, procedural fairness and collective land issue is still the focus of the construction of a system of planning inspectorate.
