论我国对著作人身权的限制

On the limit of personal right of copyright law of our country

我国著作权限制制度主要是对针对著作财产权利进行限制,法律中并未直接规定对著作人身权的限制。这并不意味着在我国不存在着对著作人身权的限制,实际上在著作财产权的限制中已隐含着对著作人身权的限制。结合我国著作权财产权限制条款设置的具体目的分析其中包含的对著作人身权的限制,主要包括了对署名权、保护作品完整权、修改作品的权利的限制。

The limit system of our copyright is mainly aimed at the property of works and no direct stipulation of personal right limit can be found in our laws, which does not mean there is no limit of personal right of works. In fact, the limit of personal right is included in the limit of property right of works. According to the specific purpose of establishing the clause of property right limit of copyright, this paper analyses the personal fight limit of copyright, including limit of signature right, right of protection of complete works and right of modifying works.
