摘要
侵权法和责任保险是两个各自独立却又紧密联系、相互影响的体系。本文分别介绍了德国侵权法的法律体系和德国责任保险的概况,以及德国侵权法与德国责任保险之间的相互影响。中国和德国同为大陆法系国家,现行和未来的侵权法又直接或间接地受德国的影响较深,因此,德国在侵权法和责任保险之间的互动关系所涉及经验和教训值得中国借鉴。
The tort law and liability insurance are two separate and yet related and mutually influencing systems. The paper first introduced the legal system for the tort law in Germany and the situation of liability insurance there respectively, and then discussed on the inter-relationship between them. Similar with Germany, China also belongs to the continental system, and its current and future tort law has been or will be affected by the German system directly or indirectly to a fairly advanced level. Therefore, the interaction between the tort law and liability insurance in Germany and related experiences and lessons are worth learning by their Chinese counterparts.
