摘要
依据法社会学中的现象学方法论,文章对乙肝病毒携带者就业歧视问题进行新的思考。第一,关注人们对乙肝问题的认识及对相关法律规范的认同态度;第二,采用法社会学中的法律多元主义、法律接受和法律对利益的调整功能等理论作指导,从人们主观的利益衡量和客观的法律缺陷两方面进行分析,找出影响法律规范有效运行的因素,以认识我国乙肝病毒携带者就业歧视深层问题;第三,从完善法律、建立社会保障制度和发展公益事业等方面出发,提出改善乙肝病毒携带者就业状况的对策。
Based on the methodology of phenomenology in legal sociology, this paper finds out people's attitude toward HBV and some legal norms protecting the employment rights of HBV carriers. Coincident with the guidance of law-diversity, law-response and the adjustment function of legal interests, it analyzes how people estimate their benefit and the defect of these legal norms, to inquire into the impediments which impact the operation of these legal norms and look into the causes of discrimination against HBV carriers in employment. Finally, to eliminate the unfair treatment to HBV carriers, several ways are proposed to improve the legal norms as well as the social security and build up the non-governmental organization.
