Initial Study on Absorbable Offense

吸收犯是一个争议颇多的概念,其与牵连犯、连续犯之间存在着错综复杂的关系。准确描述吸收犯与牵连犯等相关概念之间的关系并重新进行理论架构已经成为当务之急。有鉴于此,本文从分析吸收犯的内涵入手,围绕着"吸收犯与牵连犯的关系"这一关键性命题进行论证,最终形成了以吸收犯取代牵连犯的设计方案。

Absorbable offense is a concept with a lot of dispute whose intricate relation with implicated offense and continual offense. So it becomes task of top priority to describe accurately the relation between absorbable offense and such relevant concepts as implicated offense and to build up new theory frame again. In view of this, this article starts with analyzing the concept of absorbable offense, concentrates on the key question about the relation between absorbable offense and implicated offense, finally has formed the design plans that absorbable offense replaces the implicated offense.
