摘要
作为协调劳动关系的重要依据,劳动合同法确立了对劳动者合法权益的保护,确保了员工在劳动条件、安全生产、工资福利等方面的基本人权。然而,基于降低用工成本的动机,一些企业千方百计地规避劳动合同法,漠视员工的合法权益,凸显了其对劳动者社会责任的缺失。为了解决这一难题,当前亟需建立企业自主履行对员工社会责任的长效机制,将劳动合同法的外在约束转化为企业履行对员工社会责任的内在激励,形成劳动者权益保障与企业可持续发展的统一。
As an important basis for coordinating the labor relations, the Labor Contract Law established the mechanism for workers to protect their legitimate rights and interests. It also ensures the working conditions for workers, safety in production, wages and benefits, and other aspects of basic human rights. However, based on the motive of lower labor costs, some companies shirk their social responsibilities, and do everything possible to circumvent the Labor Contract Law and ignore legitimate rights and interests of employees. At presentl a longterm mechanism to carry out the social responsibilities of a business should be setup so as to solve the problems Moreover, it is of importance to take the Labor Contract taw as the inhereni ineentives for a business to fulfill the social responsibilities.
