改革开放30年中国教育法学研究的回顾与展望 被引量:19

Review and Prospect of the Science of Educational Law in the Past Thirty Years of the Reform and Opening Up in China

摘要 近30年来,我国教育法学在学术研究、人才培养、参与国家政策与立法咨询等方面取得了令人瞩目的成就,在确立教育法学的学科地位、与教育法协调发展的同时,注重运用教育法学原理分析教育体制改革中的热点问题。但我国教育法学研究在回应现实、学科体系构建与贡献、研究方法上存在比较明显的不足。教育法学基本理论问题和进入21世纪以来教育法律问题的新动向,为我们开辟了我国教育法学研究的新视野。 In the recent thirty years, the science of educational law in China has achieved remarkable achievements in many aspects such as academic research, talent training and participating in the consultation for the state legislation and policy-making. The science of educational law has been established as a discipline and kept pace with the development of educational legislation- At the same time, the principle of the science of educational law has often been applied to the analysis of the hot issues in the reform of educational system. However, there are some obvious deficiencies in the research of the science of educational law in the aspects of its response to the reality, the construction and contribution of the discipline system and research methods. The new trends in the fundamental theory and problems of the science of educational law in the 21st century have pioneered new perspectives for the research of educational law.
