摘要
笔者在《渔业权研究(1)》中,对渔业权的定义,渔业的主、客体,渔业权的基本特征及机能等进行了分析,并揭示了渔业权与渔业许可的本质区别。本文结合我国现行的渔业法律管理制度及渔业生产实际,对渔业捕捞权进行了分类研究,并阐述了渔业权权利人的确定、渔业权的管理及变动等,为渔业权制度的实施提供了具体的思路。
In the paper of ＂fishery rights （1）＂, the author analyzed the definition of the fishery right, and its basic characteristics and functions. Author revealed the essential differences between fishery license and fishery rights. In this paper, author combined current fishery legal management system with actual fishery production, and classified fishing rights and clarified obligee determination, fishery management and its changes etc, in order to provide the specific suggestions to implement the fishery fights system.
