摘要
馆藏文献数字化是一种建设数字图书馆的重要方式,其法律性质是复制权和信息网络传播权的结合,面临着海量许可和无过错侵权责任两个困境,重点从制度内适应(现实应对策略)和制度外创新(理想破解之道)两个方面来提出解决办法。
As a important method of constructing digital library, the legal nature of the digitalization of holdings is combination of the right of reproduction and information network dissemination, being faced with two predicament of large licensing and tort liability without fault which can be resolved from two facets of adaptation inside system （realistic countermeasures） and innovation outside system （ideal solving methods）.
