以一社会热点问题为切口,借助"科斯定理"分析"权利冲突"问题时的独特视角,讨论和分析了该案件的权利配置选择问题,并由此批判了当下中国过分强调"左与右"的思潮的对立,由此衍生罗尔斯关于重叠共识的理论,并指出中国当代的学者和知识精英的重要责任,即维护多元社会价值的同时应该力图寻找和确证多元价值中的重叠共识。

This article using ＂Coase theorem＂ to analyze the hot social issues - - -the ＂Disclosure Event＂ related to Prof. Yang Shiqun in ECUPL and argues that the division of The Right and The Left in to- day＇ s China＇ s intelligentsia is not helpful. The article points out that the most important responsibility and conscience for China＇ s today＇ s intellectual talents are to build up and locate the ＂Overlapping Consensus＂ on the basis of the social diversity.
