在对比中国《票据法》与国外相关票据法律后,我们会发现我国的《票据法》限制甚至禁止了一些票据功能。那么立法者在法律移植的过程中究竟是出于怎样的考虑,我国《票据法》在立法与实践中又存在怎样的矛盾和尴尬,本文从信用基础这样一个视角对《票据法》的立法进行一些思考。

By comparing China＇s Law of Bill with foreign-related legal instruments, we will find that China＇s Law of Bill restricts or even prohibits a number of instrument functions. The legislators are based on what kind of consideration in the process of legal transplantation, and what kind of contradictions and embarrassment are there in the legislation and practice？ This article reflects on the legislation of Law of Bill from the perspective of social credit.
