On the Minimum Standard of Procedural Justice for The Procedure of College Student Punishment

我国的高校学生纪律处分程序距离程序公正的最低要求还有很大差距,这一现状降低了高校学生纪律处分决定的正当性及合法性,在高校与被处分学生之间产生了诸多矛盾和分歧。因此,按照最低程序公正要求改革我国高校学生纪律处分程序十分必要。

There is still a great gap between the Minimum Standard of Procedural Justice and the Procedure of College Student Pun- ishment Procedure of China,which depresses the justness and legitimacy of this procedure,and causes many conflict between col- leges and punished students.Therefore it＇s necessary to reform the current procedure according to the Minimum Standard of Procedu- ral Justice,adjusting and re-constructing the procedural factors,including separating of institution＇s function,effective hearing of witnesses,ensuring the right to know,and effective appeal procedure.
