摘要
国际海上货物运输法的强制性体制是伴随着海运承运人归责原则的更迭,及国际海上货物运输法的统一与分化不断演进的。"国际海上货物运输法的强制性"与"航海过失免责"两者之间应是动态的"从属"关系。国际海运界在"海上货物运输法强制性"的价值上不断地进行法经济学价值博弈。"海运方式"决定了承托双方在海运贸易方式下的力量均衡在目前科技水平下将长期不能实现。国际海上货物运输法的强制性体制在整体上将会存续相当的时间,其中的某些强制性规范如"航海过失免责"会因失去存续的基础而被废黜。
The mandatory system of international nautical transportation goes accompanied by the alteration of responsibility rule for nautical transportation carrier and the conversion and diversion of nautical transportation laws.The relation between mandatory feature of nautical law and nautical fault exemption ought to be dynamic subordination.Judicial-economical value gaming on mandatory fea- ture of nautical transportation laws has been constantly performed for long within circle of international nautical transportation.Type of nautical transportation determines that it can't reach a balance between cartier and consignor in case of science and technology level for the time being. This mandatory system,from which some item such as nautical fault exemption will be abolished due to its non-existing base,will last entirely for quite long.
