摘要
网络技术对传统的版权法提出了严峻的挑战,版权立法必须对此做出回应,以构建新的适应网络环境的版权利益平衡体系。文章梳理了我国现行的网络版权立法,指出了取得的成绩及存在的不足,提出了完善我国网络版权立法的指导思想、基本思路及具体制度设计建议。
Network technology challenges the traditional copyright law severely, so copyright legislation must respond, in order to build a new balanced system of copyright interests which can adapt to the network environment. The paper reviews the present network copyright legislation, and points out the achievements and shortcomings; in addition, it also puts forward the guiding principle, the basic idea and the specific system design of improving copyright legislation of China.
