人身损害赔偿中精神抚慰金的评算是侵权行为法中最具有实践性的一个问题,迄今为止,我国理论界和实务界都还没有形成一个统一的适用原则。文章通过比较各国立法例,结合本国国情,认为应当区分经济发展状况制定不同的计算标准。

The calculation of mental injury compensation in personal injury compensation is a major practical problem in tort. Up to now, there isn＇t a unified principle of application theoretically and practically. Through comparing the legislations of different countries and combing China＇s national situation, the paper displays that the different calculation standards should he formulated in keeping with distinguishing the conditions of economy development.
