基于法理的流域环境权构建

Construction of Environment Right of Watershed Based on Jurisprudence

当前我国流域生态环境的恶化已经严重影响国民经济的发展,其主要原因是在流域环境的管理和保护中忽视了流域环境权利群共同作用时的体系效应与生态整体性相联系。因此,需要构建以环境权理论、系统论、外部不经济性为理论基础的流域环境权,把流域环境各种资源权利作为一个权利群进行研究,从而为我国环境权理论的发展和完善、流域管理机构的改革以及流域环境立法和流域环境管理实践提供一个全新的视角和思路。

At present, the deterioration in ecologic environment of watershed has seriously affected the development of Chinese economy, and the main reason lies in the neglect of systemic effect and ecological integrity caused by environmental rights during the management and protection. Therefore, people should construct an environmental right of watershed on the base of the theory of environmental right, architectonics and external diseconomy, and regard the right to various resources within a watershed as an unit, to provide a new perspective and idea for the development of environmental right theory, the reform of authority on watershed, and the practice of interrelated legislation and management.
