Institutional Research on the Usage Right of Rural Homestead

从新农村建设与农村宅基地使用权制度的关系出发,结合当前农村宅基地使用权制度体系的基本特征,通过实证调查分析我国农村宅基地使用权制度存在的问题,提出我国农村宅基地使用权制度创新的思路。应当加强立法,完善农村宅基地使用权法律制度体系;明晰产权,强化农村宅基地使用权权能;强化市场功能,明晰市场配置和政府配置的边界。

Commencing from the relationship between new countryside construction and usage right to rural homestead, with a combination of the basic characteristics of the current rural homestead usage right systems, an empirical investigation and analysis is made on the existing problems in China＇s rural homestead usage right systems, putting forward an innovative philosophy for China＇s rural homestead usage right system： it＇s necessary to strengthen legislation and improve the rural homestead usage right system, to clarify property rights and strengthen the right to use the empowerment of rural homestead; to strengthen market function and clarify the boundaries between market alloeation and the government configuration.
