WTO框架下电子传输产品贸易的分类问题及其对策研究

On the Classification of Digitally Transmitted Content Products and Its Potential Countermeasures in the Context of WTO

电子商务问题已成为世界贸易组织(WTO)框架下谈判的重要议题,而电子传输产品贸易由于涉及GATT、GATS和TRIPS等几个WTO最为重要的协议成为电子商务议题中最为复杂的一部分。本文回顾了近十年来WTO电子商务谈判中关于电子传输产品分类的争议,分析了各种分类方法的优点和缺点,并探讨了WTO框架下电子传输产品贸易的规制方法及其可能走向。

E-commerce has become an important issue for the WTO-the most important trade forum for the countries of the world. As the most complicated part of e-commerce issues, trade in digitally transmitted products is related to almost all of the important WTO agreements such as GATT, CATS and TRIPS. This paper reviews the 10-years controversy over the classification of digitally transmitted content products under the frame of e-commerce negotiation, analyzes the advantages and disadvantages of the different approaches to classification, and probes the possible direction of regulations of digitally transmitted content products.
