论特别窝藏犯的民事责任

On the Civil Liability Taken by Special Harbor Criminals

1998年《最高人民法院关于执行〈中华人民共和国刑事诉讼法〉若干问题的解释》规定,在特殊情况下窝藏犯承担有限连带责任。但是,要求特别窝藏犯承担连带责任的正当性并不充分。补充责任不仅能充分保护被害人的合法权利,也明确了附带民事诉讼被告为终局责任人,有利于保护特别窝藏犯的正当利益。因此,特别窝赃犯承担补充责任较妥当。

Interpretations of Supreme People＇s Court on Implementing the Civil Procedure Law of the People＇s Republic of China （1998） stipulates that harbor criminals may bear limited joint liability in special circumstances. However, this paper tries to prove that the validity of civil liability bear by special harbor criminals is inadequate. Supplementary liability may fully protect victims Slegal rights, and defines the defendant in collateral civil action as the essential liable person, so as to protect special harbor criminals＇ legitimate interests. Therefore, the supplementary liability is more proper than the joint liability which is bore by special harbor criminals.
