On Legal Attributes of Doctor-Patient Relations

医患关系的法律属性问题是全部医事法学中最重要、最基本的问题,而我国法学界对该问题尚未达成共识,因而造成医疗纠纷处理上的司法混乱。本文拟从医患关系的基本属性、基本形态及其特殊性入手,着重分析医患关系的法律属性。

Legal attributes of Doctor--Patient Relations in all medical jurisprudence are the most important and basic issues. In the law field of China, experts have not yet reached a consensus on the issue, resulting in judicial confusion of medical treatment disputes. From the basic attributes, the basic pattern and specificity of doctor-patient relations, this paper focuses on the analysis of the legal attributes of doctor-patient relations.
