从学理走向规范:国际恐怖主义概念新探——兼论国际恐怖主义概念的研究方法之转换

From Doctrine to Norm: a New Study of the Concept of International Terrorism

国际反恐斗争需要明确国际恐怖主义的概念。目前国内学界关于国际恐怖主义的研究方法主要是一种学理概念研究,因此有必要提倡"从学理走向规范"的研究方法,即应加强法律(规范)概念研究,应在现行有效的13个全球性反恐条约中的各种特定国际恐怖主义法律概念的基础上,通过联合国大会等平台,在《恐怖主义全面公约》(草案)中尽快就一般性国际恐怖主义法律概念在联合国框架内达成一致。

The concept of international terrorism needs to be clearly defined for the fight against international terrorism. The research methods currently applied by the academic circle in China mainly belong to doctrinal research which focuses on the concept of international terrorism. It is necessary to advocate a research method called ＂from doctrine to norm＂ which stresses the studies of legal concepts （norm）. The author argues that general legal concepts of international .terrorism should be unified in Comprehensive Convention against International Terrorism （ Draft ） through the Assembly of United Nations, based on the legal concepts of international terrorism in the existing 13 global treaties against terrorism.
