刍议垃圾电子邮件的法律规制

On the Legal Regulation of Spams

全球互联网的快速发展,电子邮件的使用已与人们的日常生活密不可分。随之泛滥的垃圾电子邮件侵蚀着网络社会的互信与资源,引发了诸多的法律问题。而我国目前还没有直接规范垃圾电子邮件的法律法规。法律法规的欠缺是垃圾电子邮件泛滥的重要原因之一。因此通过对国外反垃圾邮件立法借鉴,结合我国实际,提出规制垃圾电子邮件的立法建议,以求遏制垃圾电子邮件的泛滥趋势。

With the rapid development of World Wide Web, e-mails have become indispensable in our daily life. Mean- while, an overwhelmingly huge number of spams have damaged the trust and resources of the net-society, triggering a wide range of legal issues. Nevertheless, China witnesses a lack of laws and regulations to regulate spams. Therefore, the author has raised suggestions on the regulation of spares on the basis of the research on it by comparing the anti-spam legislation abroad and the status quo of China so as to control the negative flooding of spams.
