摘要
单机游戏时代的对战平台和网络游戏时代下的私服,都是以一定的技术手段使盗版游戏软件的使用者得以规避游戏开发商所设置的著作权保护技术措施。二者事实上构成对游戏开发商著作权的侵犯。文章从相关案例入手,阐释了对战平台和私服的含义、性质,分析了中美两国关于网络游戏中对战平台和私服侵犯知识产权的案例以及两国对此不同的处理方式。
Both the battle platform in the single computer games and the private server in online games use a certain kind of technical means to help the pirate game software users to evade the copyright protection. The battle platform and the private server will infringe the copyright of the game producers. This paper discusses the definition and nature of the battle platform and the private server, and analyzes some cases involving the infringing of the copyright in China and USA as well as their different ways of treating such cases.
