摘要
立法部门在《消费者权益保护法》中首次设置惩罚性赔偿责任,但在司法实践中还存在诸多争议性问题。通过分析了产品局部欺诈应当作整体惩罚性赔偿以及"消费者"的范畴应当包括商品使用者这两大争议性问题,提出了完善我国惩罚性赔偿制度的相关建议。
In the law of the People's Republic of China on the Protection of Consumer Rights and Interests, for the first time legislature sets the responsibility for punitive compensation. But, in the applying process, there are many questions which have been still discussed by people in judicial practice. In this paper, an analysis of the two controversial issues is made: Product local fraud should be the overpunitive damages; the category of "consumer" should include the commodities users, and put forward the perfect proposal
