On both Application and Improvement of Strict Responsibility Principle in Product Responsibility—Inspired by Sanlu Milk Food Scandal

三鹿奶粉等缺陷产品致人损害事件,使全社会再次关注产品质量和产品责任问题。本文通过对严格责任理论历史的溯源和分析,对我国产品责任法及归责原则现状进行梳理,阐述产品责任中适用严格责任的合理性,对产品责任法适用和完善严格责任原则提出设想和建议。

Sanlu mik food scandal draws attention to product quality and product responsibility. Reviewing the literature on strict responsibility, the paper sorts out the actualities of Chinese product responsi- bility law and principle of culpability, expounds the rationality of the application of strict responsibility in product responsibility, and makes tentative suggestions on the application and improvement.
