生物技术产业风险投资中知识产权保护问题探讨

Study the problem of intellectual property for Venture capital in the biotechnology industry

风险投资可以解决生物技术产业发展的资金短缺问题,但对生物技术产业知识产权保护提出更高要求。通过知识产权法律和生物基因技术措施来保护生物技术研发的知识产权,是世界生物技术产业产权保护的两种主要手段,笔者分析了国际现行的这两种保护手段及其存在的争议,并提出了一些加强生物技术产业知识产权保护的建议。

Venture capital can solve fund shortage of the bioteehnology industry development, but need more better protection of intellectual property about the biotechnology industry. Intellectual Property Law and bio-genetic technology are two main protection means of the biotechnology industry in world at present. The article analyzed the two main means and their dispute, and provided some advices to strengthen protection of intellectual property fights in the biotechnology industry.
