摘要 我国劳动关系正处在深刻的变动中,劳动关系双方不同的利益诉求引发的劳动争议日益凸显,并成为影响经济发展和社会稳定的重要因素。劳动争议的产生,既有劳动和资本对抗性依附的共性,也有转型期特有的制度困境和利益逻辑。合作主义的价值内涵重视协调和整合,有助于劳动关系治理的平稳转型。在合作主义治理模式下,寻求劳动关系双方的"合作因素",构建多方参与的治理机制,成为我国构建和谐劳动关系的现实性选择。 China's labor relations is undergoing profound changes. Labor dispute caused by different benefit demands become more obvious and an important factor on economic development and social stability. The cause of labor disputes lies in the common attachment of labor and capital confrontational and system difficulties and benefit logic during the transition period. Cooperation values the coordination and integration and contributes to govern the labor relations in transition smoothly. In the governance model of cooperation, it becomes the rational selection to build a harmonious labor relations that the the two sides between the labor relations seek "cooperative factor" and build a muhi-stakeholder governance mechanisms.
