反垄断规制的成本分类——以我国反垄断机构的设置为例

A Taxonomy on the Costs of Antitrust Regulation:A Case on the Establishment of China's Antitrust Agency

反垄断规制的成本可以划分为启动成本和运行成本。前者包括制度和组织的创设成本,启动的环境成本和反应成本,后者包括组织的运行成本和约束成本,运行的环境成本和反应成本。在总成本中,运行成本占绝对份额,在运行成本内部,环境成本特别是反应成本占绝对份额。在成本分类的基础上,本文最后又分析、比较了我国反垄断机构的一些设置方案。

China＇s antitrust costs could be divided into two categories： costs of starting and costs of running. The former includes costs of setting up the institution and the organization, and costs of matching and reacting. The latter includes costs of running and restricting the organization, and costs of matching and reacting. In total costs, costs of running in the broad sense hold the largest portion, and in costs of running, costs of matching and especially costs of reacting hold the largest portion. On the basis of the taxonomy, this paper finally analyses and compares some proposals to China＇s antitrust agency.
