法律语言学学科建设的思考——从我国法律文件的英译谈起

Reflections on the Discipline Construction of Forensic Linguistics——From the English Translation of Chinese Legal Documents

目前我国法律文件的英文译本较多地体现了中国法律法规原文的特征,一些错误用法被反复使用,在一定程度上形成了"中国式法律英语"。这一现象提示我们反思法律英语译本存在的若干问题。法律英语必须着眼"语言目标"而非"知识目标",回归其作为法律语言学课程分支的本质,才能适应在经济全球化背景下我国法律人才的培养需要。

The English translations of Chinese laws and regulations largely embody the stylistic features of the original texts. Some misusages are practiced repeatedly, which helps to create ＂legal Chinglish＂ to some extent. This phenomenon shows that promotion of the discipline development of forensic linguistics in higher education should begin with reforms on legal English teaching. The course of Legal English, which is a branch of forensic linguistics in essence, must focus on the language itself instead of being knowledge - based to meet the demand of Chinese legal talents training in a global economy.
