On the System Changes and the Reform Path of Business Administration Permission in China

我国营业行政许可制度经历了"计划经济时期的普遍行政许可——改革开放时期的严格行政许可——2003年以后的例外行政许可"三大制度变迁阶段。选择并不断完善例外主义营业行政许可的制度范式,有利于建立我国未来自由、开放型营业准入制度,切实维护民事主体的营业自由权利,充分释放投资主体和营业主体的营业潜能,实现经济的可持续发展。

Business administration permission in China experienced three stages from general administrative permission in the planned economy period to the strict administrative permission in the reform and opening period, and to exception administrative permission after 2003. To select and contin- ue to improve the system model of the exception administrative permission will have enormous significance to establish free and open business access system in future, and safeguard effectively the business freedom right of civil subject, and release fully business potential of investor and operator and achieve continually development of economy in China.
