我国投资领域中国民待遇现状分析

Current Situation Analysis of National Treatment in China's Investment Field

目前,我国投资领域看似繁荣但问题错综复杂,国民待遇适用的标准混乱已经恶化了我国的投资环境,主要体现在国民待遇与非国民待遇并存,内资待遇标准的不一致,外资上位法与下位法的不一致,外资法与WTO及双边协定的规定不一致等方面。应从调整并理顺内资法律法规及其政策,统一内资的法律地位和待遇标准;建立统一适用的外资待遇标准,取消对外资的非国民待遇;清理和调整地方性法规及其政策中与WTO和双边投资协定及国家外资法律法规不一致的外资待遇规定;加快制定体系完整、前瞻性强的外国投资法步伐等方面入手,完善我国外资待遇立法及政策。

Now in China＇s investment field, seemingly prospect but complicated, the confused standard on national treatment has deteriorated our investment environment, which mainly lies in the coexistence of national and non-national treatment, and in inconsistency of standards in domestic capital, that of higher-level law and lower-level law in foreign capital, and that of foreign investment law and the regulation in WTO and bilateral agreement. Therefore, we should take some measures to improve our treatment legislation and policy on foreign capital as following： adjusting and unifying legislation and policy on domestic capital, building consistent treatment standard on foreign capital and canceling non-national treatment to foreign capital, adjusting inconsistent treatment regulation on foreign capital with WTO, bilateral agreement, and national laws and regulations on foreign capital existed in regional regulations and policy, and quickening the pace to enact complete and prospective foreign investment law.
