居民身份证犯罪的法律适用分析

居民身份证犯罪包括两个方面:其一为伪造、变造居民身份证的犯罪行为即伪造、变造居民身份证罪,在司法实践中应当注意罪与非罪界限、本罪与类似犯罪的区分、既遂、罪数问题;其二为利用居民身份证从事犯罪活动的犯罪行为,在司法实践中应当注意罪名认定与违反治安管理行为的区别。

The crime of citizen＇s ID card includes： First, having the following actions to forge or alter citizen＇s ID card.In juridical practices we shall pay attention to the limit to guilt and innocence, the difference with other similar crimes, accomplished offense and several crimes. Second, committing crimes by using citizen＇s ID card.In juridical practices we shall pay attention to the accusation confirmation and the difference with deregulation of public security management.
