论我国农村土地承包经营权的物权化及其意义

作为物权的农村土地承包经营权具有较强的强制性,当事人的自主意愿受到极大的制约,但是它却能够给经营权人提供较为充分的法律救济。利用物权制度独具的优势对我国农村土地承包经营权进行制度改革,对于保护承包经营权人的利益、提高农村土地利用效率和调整农村土地利用关系都具有十分重要的意义。
