伴随着网络技术的发展,网上仲裁应运而生并有方兴未艾之势。网上仲裁是一种完全或主要通过网上进行的、用来解决因在线或非在线交易所引起的各种性质争议的解决方式。网上仲裁本质上具有传统仲裁的特征,但又有一些特殊之处。影响网上仲裁发展的法律因素包括书面形式、仲裁地、正当程序、裁决的承认与执行等问题,尤以仲裁地的认定为重。因此,从立法上加以规范对网上仲裁的未来发展起着至关重要的作用,而网上仲裁的立法模式的选择又显得尤为重要。

Online arbitration is a type to settle various disputes caused in online or off - line overall or mainly through online. It has the feature of traditional arbitration in essence, but still has its special feature. The legal factors that affect its development include written form, arbitrative and normal process, the recognition and the enforcement questions, where the recognition one is important. Therefore, the normalization of legislation plays the important part for the future development of online arbitration and the selection of legislative model of online arbitration is still more important.
