高校自治权与学生受教育权的平衡机制探析——以国家权力对教育纠纷的介入为视角

Balance between Right to Education and Autonomy of University --State Power Intervene Educational Issue

目前,我国高等教育领域的纠纷呈逐渐上升趋势。从本质上看,高校与学生因管理行为引发的法律纠纷,实际上是高校自治的管理权力与学生受教育的权利之间的冲突。为使二者的权利义务达到平衡状态,必须要有国家权力———立法权、行政权和司法权来介入纠纷的解决,同时也要处理好国家权力介入的程度的问题。
