论高校学生申诉制度功能的失落与复归

On loss and reversion of the function of student appeal system in universities

救济学生的合法权利和监督规制高校教育管理权是高校学生申诉制度的两大基本功能。然而在现实中,学生申诉制度在一定程度上失落了其应当彰显的功能,呈现出"权利救济虚置"和"权力监督困境"的问题。要实现学生申诉制度功能的理性复归,制度设计的修正与完善是根本的路径选择。

Relieving students＇ legal rights and supervising administrative power are two basic functions of student appeal system in universities. But in fact, the student appeal system has lost its proper functions to some extent with the problems of ＂nominal right relief＂ and ＂power supervision dilemma＂. In order to rationally reverse to functions of the student appeal system, amending and perfecting the system design should be the basic route choice.
