论迁徙自由在中国的确立与实现——价值、契机与措施

The Establishment and Accomplishment of Migration Freedom in China

迁徙自由是人的一项基本权利,是国际人权法的重要内容。广义的迁徙自由包括国内迁徙自由和国际迁徙自由。迁徙自由有着多方面的重要价值。随着改革开放的深入和社会经济的发展,确立公民的迁徙自由已成为中国人权事业发展的大势,这也是中国履行国际义务的要求。目前我国可以签署《公民权利和政治权利国际公约》以及制定《国家人权行动计划》为契机,在宪法上恢复公民的迁徙自由权,并逐渐采取相应措施,使这一权利得到落实和保障。

The freedom of migration is a basic right for human being; it is an important part of the international law of human rights. It has values in many respects, especially in that of law. China＇s social and economic development has proven the necessity and feasibility for establishing the residents＇ migration freedom. In fact, it is a general trend that should be taken seriously into consideration. For the moment, therefore, China can issue International Covenant on Civil and Political Rights and make Chinese National Human Rights Action Plan to restore gradually the residents＇ migration freedom. And then steps might be taken for the implementation and guarantee.
