跨流域调水生态补偿法律问题分析--以南水北调中线库区水源区(河南部分)为例

On Legal Issues of Ecological Compensation in Inter-basin Water Transfer——Taking the Water Resource Area of Middle Line Project for South-to-North Water Diversion in Henan Province as an Example

生态补偿是一种使外部成本内部化的环境经济手段,生态补偿机制是自然资源有偿使用原则的具体体现。笔者分析生态补偿的内涵及其理论基础,以南水北调中线库区水源区(河南部分)为例,论述补偿的原因、受偿区提供的生态服务的价值、补偿主体、受偿主体、补偿标准、生态补偿资金的筹集与使用等问题,并讨论对跨流域调水生态补偿的手段及实施保障等问题。

Ecological compensation mechanisms are the significant instruments and measures to realize payment for environmental resources services. Based on the literature available, this article analyzes the concepts and theories of ecological compensation. In the light of the actual situation of the water resource area of middle line project for South-North Water Diversion in Henan Province, the paper discusses the methods of eco-compensation mechanical construction of this area concerning compensation subjects, compensation standards, as well as raising and utilizing of the ecological compensation funds. This article also gives some suggestions on the means and safeguards of the implementation of ecological compensation for inter-basin water transfer.
