复行为犯的实行行为研究

A Study of Perpetrating Act of a Compound Behavior Crime

复行为犯是由两个或者多个行为相结合而形成的规范的实行行为所构成的犯罪,具有规范性、实行性等特征。因其内部构成行为具有复数性,对其实行行为的单复存在着不同看法。作为犯罪实行行为的一种表现形态,复行为犯的实行行为与简单行为犯的实行行为只有自身结构复杂程度的不同,并无数目上的差别;复行为犯作为单纯一罪,只能有一个实行行为。在司法实践中认定复行为犯实行行为时,需确立4个标准:以刑法分则条文的规定为基本标准;结合实质标准;综合考虑形式标准;注意是否违反禁止重复评价原则。

A compound behavior crime refers to a normative perpetrating act combined with two acts or plural acts, which has the features of regularization and designation. Does that mean that the compound behavior crime has two perpetrating acts because of the internal plural acts? The number of perpetrating act of the compound behavior crime is the same as that of a behavior crime. They are different in their complicated behavior structure. In judicial practice, in order to confirm perpetrating act of the compound behavior crime, four criteria should be taken into consideration, that is, the specific provision of Criminal Law of the People’s Republic of China, the essential criterion, the formal criterion, and the principle of prohibiting repetitive assessment.
