摘要
涂尔干认为刑罚不仅具体反映了社会的道德秩序,同时也是道德秩序表述和维系自身的例证。在对刑罚功能及其道德意义的详细论述以及关于刑罚的历史演进及其与社会形式演进的关系的长篇论文中,涂尔干始终将刑罚实践与社会生活的核心组成元素和过程结合在一起。
Durkheim argued that punishment not only reflects specific moral order in society, but exemplify moral order expression and maintaining. In his long article on the function of punishment and moral meaning, as well as the article on the relationship between the historical evolution of punishment and the its forms, Durkheim has combined penal practice and core elements and process of social life all the time.
