变动国际体系中国际法院作用的评估

On Evaluation of the Role of ICJ in a Changing International System

在国际体系向全球化时代变动的过程中,国际法院的积极作用日益明显。至今为止,国际法院在冷战后的表现让人欣慰不已,但考虑到常设国际法院及国际法院在一战、二战后共有的先盛后衰的经历,对国际法院的表现抱以谨慎的乐观态度才较为妥当。国际社会应该给予国际法院更多表现其公正的机会。

During the process of international system moving towards the era of globalization, the positive role of the International Court of Justice is increasingly obvious. So far, it is really comforting to see the performance of the International Court of Justice after the Cold War. However, in view of the common experience of going from thriving to declining of the Permanent Court of International Justice and the International Court of Justice after World War One and World War Two, it is more appropriate to hold a discrete and optimistic attitude towards ICJ＇ performance. The international community should give ICJ more opportunity to display its justice.
