民事调解的检察监督

Procuratorial Supervision of the Court Mediation in Civil Procedure

对民事调解案件进行检察监督不违反当事人处分原则,符合《宪法》和《民事诉讼法》的精神,与诉讼经济原则也并无矛盾。检察监督的范围,应界定在调解案件违反自愿原则和合法原则的基础上,监督宜采用再审检察建议的形式。

The procuratorial supervision to the civil mediation cases does not violate the principle of disposition, conforms to the conception of the constitution and the civil procedure law, and does not conflict with the economic principle of lawsuit. The scope of the procuratorial supervision should be the mediation cases against the voluntary and legitimate principles ; and the procuratorial advice to initiate the retrial should be the suitable method of supervision.
