采用逻辑分析法和现象溯因法探讨了如何合理确定水资源使用权初始分配的年限,指出我国水资源使用权的初始分配年限应具有相对稳定性、渐进性和针对性的特点,在具体确定时,应从水资源所有者、水资源使用者和水资源使用的社会效益3方面的影响来分析,根据用水主体和水资源使用目的不同,分区域和用水户2个层次来灵活确定水资源使用权初始分配的年限。

By use of the logic analysis method and the phenomenon ratiocination method,how to rationally determine the initial allocation years of water resources use right was discussed.It was put forward that the initial allocation years of the water resources use right in China should have the characteristics of relative stability,graduation and pertinence.As for the determination of the initial allocation years of water resources,the effects of the water resources owners,the water resources users and the social benefits of water resources use should be analyzed.According to the subject and purpose of water resources use,the initial distribution years should be determined to be 2 levels: regions and users.
