现代远程教育环境下的信息网络传播权限制

基于互联网发展起来的现代远程教育与信息网络传播权有着极为密切的关系。对信息网络传播权给予合理限制有助于维系著作权人和公众利益的平衡,促进远程教育的发展。本文阐述了现代远程教育环境下信息网络传播权限制的正当性,评价了我国的相关立法,并就远程教育中的信息网络传播权限制制度的完善提出了若干可行性建议。

Modern distance education based on network is closely linked with information network propagating right. Reasonable limitation of information network propagating right helps to balance the interests of the author and the public, and promote the development of distance education. The rationality of limiting the information network propagating right in the modern distance education environment is discussed. The relevant legislation in China is analyzed. Finally, the paper puts forward some feasible suggestions as to how to improve the limitation system of information network propagating right in distance education.
