本文探讨了医疗保险立法的必要性及其应具备的各方面条件。旨针对当前国内开展医疗保险试点工作运行过程中的一些问题提出以法律制约为主的解决思路,并根据现行实践过程参照国外有关医疗保险立法取得的成效,强调立法的紧迫性和特殊意义。

This paper discussed the necessity and its essential conditions of the legislation for the medical insurance. Aiming at some existing problems present in the pilot studying running course for china developing medical insurance, the solving ways are suggested based mainly on the legal regulations, and based on the nowadays practicing course to the obtained efficiency referring to the related medical insurance legislation abroad, the urgency and special significance of it are stressed.
