On the Blind Evolutionism of Law

法律盲目演进主义是法律盲目演变与进化的理论统称。它的各种理论形态揭示了法律发展的盲目特性,但大都难以摆脱目的理性或大或小的影响。盲目性与目的性相互排斥、彼此不容,在特定法律发展过程中两者又不能孤立存在而是互相依存的,正是在矛盾中推动了法的进化。

The blind evolutionism of law is a theoretical name of the blind development and evolution of law. The various theories of the blind evolutionism are mostly difficult to break away more or less effect from the rationality. Mutually exclusive as the blindness and the purposefulness, they both are not purely isolated but interdependent in the special process of legal growth, and it is in the contradiction that they have been propelling the evolution of law.
