过失相抵规则在侵权行为法中起着重要的作用,体现了责任自负原则和公平公正原则。在深入分析过失相抵规则传统方法的的基础上,指出了其在实践中如何具体应用。此外,对经济分析法在过失相抵规则中的应用进行了分析,认为其不适应于实践。

The negligence offset regulation, which plays an important role in the tort law, externalizes the principle of selfabidence and the principle of fairness and impartiality. Based on the deep analysis on traditional method of the negligence offset regulation, this paper points out the concrete application of it, and makes analysis on the application of the economy analysis method in the negligence offset regulation, and holds that the economy analysis method can＇t adapt to the practice.
